These conditions of sale define the procedure for ordering, paying, delivering and returning or complaining about the goods offered on our website. The supplier (Seller) is Dea Flores d.o.o.A buyer of goods is a visitor to the web shop who selects at least one product, puts it in the shopping cart, pays by credit card, e-banking, bank transfer (payment slip) at the bank (post office or FINI) and sends the order to the Seller, or sends the order and pays for the item by cash on delivery (cash during delivery).
Through the web shop www.deaflores.com, the customer can purchase all products that are on the Seller’s website.
Prices include VAT.
The currency is Euro (EUR).

Ordering
Ordering goods is possible 24 hours a day, 7 days a week.The goods are ordered using an electronic form. If the seller is not able to deliver all the ordered items, he will deliver those that he can, and he will inform the Buyer in writing about the deadline for the delivery of the rest. The customer can accept or cancel the delivery of the remaining items. If the customer does not have an e-mail address, he will be notified by phone.

The Buyer will pay the ordered products with delivery costs (if any) to the Seller by credit card, cash on delivery upon delivery of the goods, or by bank transfer on the Seller’s website via WS Paymet Gateway with American Express, Visa or Maestro and MasterCard cards. In the event that the Buyer orders goods and refuses to receive them, the Seller has the right to ask the Buyer for reimbursement of postal and handling costs.
Conversion statement (in case of purchase from abroad)
All payments will be made in Croatian kuna. When charging with your credit card, the same amount is converted into your local currency according to the valid exchange rate list of the association of cardholders.
Returns and complaints
These Terms and Conditions as well as individual terms of sale indicated with information about specific products represent an offer by Dea Flores to enter into a Contract, and the user as a customer by registering, concluding an order or in another way determined by these Terms accepts them, which is considered to have concluded a Contract between the user and Dea Flores d.o.o., and according to the conditions of sale specified in these Terms.
The subject and commercial purpose of the Agreement is the purchase of a selected product or service through the Dea Flores web shop with payment of the appropriate fee – the price of that product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed promotional messages with purchase order, telephone with and without human mediation, and the Internet.
The contract comes into force and is binding from the moment the user accepts the Dea Flores offer in one of the following ways:
· by selecting payment and completing the order as a registered user of deaflores.com,
· by selecting payment and completing the order as a guest user of deaflores.com,
a) In the process of registering or creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required to register or create a user account must be true, and the use or use of other people’s data is expressly prohibited.
b) Registration or user account is created only for one person and it is not allowed to communicate information about registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else’s registration or user account is not allowed.
c) For violation of the provisions of the Terms and Conditions from this chapter, Dea Flores reserves the right, at its discretion, to terminate the user’s registration or user account, without the obligation to compensate the user for any cost or damage.
d) Registration (which includes payment for the service) is considered to have concluded a contract between Dea Flores d.o.o.and the user as a customer.
e) The Agreement enters into force upon the user’s registration, i.e. from the day the user accepts the offer to enter into such an Agreement.
f) On the occasion of the conclusion of the Agreement, the user will be provided with: a confirmation of the concluded Agreement, i.e. a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), these Terms and the notification of the user’s right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.
g) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. The User does not have the right to unilaterally terminate the Agreement:
– if the service has been fully fulfilled for him, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled for him,
– if the subject of the Agreement is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery,
– if the subject of the Contract is goods which, due to their nature, are inseparably mixed with other things after delivery,
– if the subject of the Agreement is the delivery of sealed audio or video recordings, or computer programs, which were unsealed after delivery, and
– if the subject of the Contract is the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts for such publications.
In order for the user to be able to exercise the right to unilaterally terminate the Agreement, he must notify Dea Flores of his decision to unilaterally terminate the Agreement before the expiration of the term, by an unequivocal statement sent by post (to Dea Flores d.o.o., Dragutina Tadijanovića 3, Rijeka), or by email to shop@deaflores.hr, in which you will state your first and last name, address, phone number, fax number or address e-mail, and can also use the specified written form for unilateral termination of the Agreement.
Also, the Form for Unilateral Termination of the Agreement located at THIS LINK can be electronically filled out and sent by the user, in which case Dea Flores will send him a confirmation of receipt of the notice of unilateral termination of the Agreement by electronic mail without delay.
The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement.
If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and no later than within 14 (fourteen) days from the day when Dea Flores, or Dea Flores, receives the user’s decision on unilateral termination of the Agreement, unless the user has chosen another type of delivery, which is not the cheapest standard delivery offered. The refund will be made in the same way the user made the payment. In the event that the user agrees to another way of returning the paid amount, he does not bear any costs in relation to the return. Dea Flores can refund the money only after the goods have been returned to him or after he has been provided with proof that the goods have been sent back.
The user is obliged to hand over the goods or send them to the address of Dea Flores d.o.o. (deaflores.com), Dragutina Tadijanovića 3, 51 000 Rijeka, without undue delay, and in any case no later than within 14 (fourteen) days from the day when Dea Flores, or Dea Flores, sent his decision on unilateral termination of the Agreement. The direct costs of returning the goods must be borne by the user. The user is requested to contact shop@deaflores.hr before termination, so that the procedure for returning the goods is explained.
The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user’s request, the execution of the service began during the term for unilateral termination of the Agreement, the user is obliged to pay Dea Flores an amount that is proportional to what was delivered up to the moment when the user informed Dea Flores of the unilateral termination of the Agreement.

h) In case of material defects, the seller is responsible for the material defects of the items he sells on his website in accordance with positive regulations, in particular the Law on Obligations of the Republic of Croatia.
In the event of a visible lack of product when receiving the shipment (e.g. damage to the packaging), the customer is not obliged to take delivery of the delivered product, may refuse receipt, and does not bear the costs of delivering such a product. It is considered that the products that were properly received by the customer had no visible defect.
If the product has a hidden defect (e.g. the product is broken, the product is scratched as a result of transport or incorrect storage) which the customer determines after opening the product without using, assembling or putting the product into operation, and which is determined by the authorized service – the customer has the right to unilaterally terminate the contract and refund money, replace the product, remove the defect or reduce the price.
i) Products for which we provide a guarantee in accordance with the law and the guarantee specified by the manufacturer have a guarantee certificate. The right to use the warranty is realized upon presentation of the invoice and warranty card. The customer is obliged to keep the warranty card and receipt. The date of issue of the invoice is the date of activation of the guarantee. Along with the product description, there is information about the period for which the warranty is provided for a specific product.
In case of issuing a warranty certificate by which the manufacturer guarantees the correctness of the product during a certain period of time, the customer can, if the product is not correct, demand that the product be repaired within a reasonable period of time, or that another such correct product be handed over to him instead of repair. If the product malfunctions during the warranty period, it must be delivered to the authorized service center specified in the warranty card.
The right to use the guarantee is exercised only upon presentation of the invoice. The customer is obliged to keep the warranty card and receipt. Product malfunction resulting from improper use and/or non-compliance with the instructions is not covered by the warranty. Servicing and sale of replacement parts for the purchased product is provided through the authorized repairers listed in the warranty card.

Dea Flores uses WSPay for online payments.
WSPay is a secure system for online payments, real-time payments, credit and debit cards and other payment methods. WSPay provides customers and merchants with secure entry and transfer of entered card data, which is confirmed by the PCI DSS certificate that WSPay has. WSPay uses an SSL certificate of 256-bit encryption and TLS 1.2 cryptographic protocol as the highest level of protection when entering and transferring data.

The customer will receive an order confirmation notification by e-mail after the purchase, which contains all the details prescribed by law.
Delivery
Delivery conditions
The goods are delivered by express delivery within 3 working days. If the products are immediately available, delivery will be made within 48 hours of receiving the order. The user will be informed about the delivery method at the time of ordering the goods (electronically or by telephone, depending on the method of purchase that the customer chooses). If the goods are not available, the Seller will inform the customer (in writing or by phone) about the possible delivery date. The customer can then accept the new delivery date or cancel the order. If the Buyer decides to cancel the order, the seller will return the money to him no later than within 30 days from the time the delay occurred, plus late interest. When taking over the goods, the buyer is obliged to check for possible damages and immediately report them to the delivery person who delivered the goods, or refuse to take delivery of a shipment with visible external damages.
Other delivery conditions
The products will be packed so that they cannot be damaged by normal handling during transport. When picking up the product, the customer is obliged to check for possible damages and immediately report them to the delivery worker who delivered the goods, or refuse to take delivery of a shipment with visible external damage. The goods are insured against loss during delivery.
Shipping cost
Postage for orders above €40 is completely free, for orders below €40 the postage is €5.91, and for items paid by cash on delivery it is €6.58.
Privacy Guarantee
We guarantee the security and confidentiality of all customer data. The data must be complete and authentic. We undertake to protect the privacy and secrecy of the personal data of all our customers, in accordance with the Personal Data Protection Act, NN no. 103/2003 and 118/2006. We only collect necessary, basic data about customers/users and inform customers about the way they are used. We regularly give customers choices about the use of their data, including the ability to decide whether or not they want their name removed from lists used for marketing campaigns. Dea Flores web guarantees that the personal data of the Web store user will never be made available for inspection and use by a third party, without the prior express consent of the user. Inspection by authorized services of the executive state power of the Republic of Croatia, for the purposes of investigative actions based on a valid court order, is excluded from this.

Dea Flores web reserves the right to amend these Terms and Conditions and undertakes to notify all registered users via the e-mail addresses they entered during registration.
